Acceptance of terms

By downloading, installing, or using the “Are You Fluent?” application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Parallax Interactive, LLC (“Company,” “we,” “us,” or “our”).

If you are under 18, or under the age of majority where you live, please read these Terms with a parent or guardian and make sure they agree to them. You must be at least 16 to use the App. How we handle your data is explained in our Privacy Policy.

Description of service

Are You Fluent? is a language learning application that provides daily interactive quizzes inspired by real-world stories and current events. The App is not a news service and should not be used as a source for current-events information. Content is refreshed periodically and may vary by language pair and difficulty tier.

Your license to use the App

We give you a personal, non-exclusive, non-transferable and revocable license to download the App and use it on devices you own or control, for your own non-commercial use. The App is licensed to you, not sold.

Except where the law expressly allows it, you may not copy, modify, sell, rent or distribute the App.

User accounts

The App creates a guest account the first time you open it, so you can start without signing up. You can link it to Google Sign-In or Sign in with Apple. Your account is for you only: don't share, sell or transfer it. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Deleting your account

You can delete your account at any time in the App, from Settings > Delete account, or by email. Deleting your account permanently removes your progress and virtual items; we can't restore them afterwards. You can also simply stop using the App.

Stars, cards and other virtual items

The App uses virtual items such as stars, album cards, coins and points. You get them for free: by answering questions and completing stories and days, as stars come back over time, and by choosing to watch rewarded videos. Some of them are used up as part of the App: for example, a wrong answer costs a star.

Virtual items have no monetary value. They are not money or property, and you can't buy them, cash them out, exchange them for money or anything of value, sell them or transfer them to anyone else.
There are no in-app purchases in the App.
Virtual items are part of your license to use the App. We may change how they work, rebalance them, or correct balances that come from errors or misuse.
They are lost when you delete your account.

The App offers optional rewarded videos: you choose when to watch one, for example to get a star back. Ads are provided by Google AdMob; we don't control their content and aren't responsible for the products or websites they promote.

Ads aren't always available, and daily limits apply. If no ad can be shown, one doesn't finish, or its reward can't be verified, the reward may not be given. Your ad and privacy choices are explained in our Privacy Policy.

User conduct

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to reverse engineer, decompile, or disassemble the App
Interfere with or disrupt the App's servers or networks
Use automated means to access or collect data from the App
Impersonate any person or entity, or misrepresent your affiliation
Share, redistribute, or commercially exploit the App's content without permission

Intellectual property

All content in the App, including but not limited to text, graphics, images, artwork, quizzes, logos, and software, is the property of Parallax Interactive, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Public RSS feeds and similar public sources may be used as inspiration for educational language prompts, attribution, and context.

Content accuracy

Some lessons, explanations, and artwork are generated or assisted by AI systems and reviewed through automated safeguards. While we strive for accuracy and age-appropriate content, AI-assisted content may occasionally contain errors or unsuitable material. The App is intended as a supplementary language learning tool and should not be relied upon as a news source, professional advice source, or the sole source of language education. You can report content in the App or contact help@prllxlabs.com.

Changes and availability

We keep working on the App. We may add, change or remove lessons, language pairs, albums and other features, and we may need to pause the App for maintenance. We don't promise that the App will always be available or free of errors. The App needs an internet connection for features such as loading daily lessons, saving your progress and ads.

We may stop offering the App. If we do, we will try to give you reasonable notice in the App or on this website.

Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms limits your rights as a consumer under the law that applies to you, including any legal guarantee of conformity for digital content.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARALLAX INTERACTIVE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

To the extent the law allows, we are also not liable for losses that come from events outside our reasonable control, from your breach of these Terms, or from third-party services such as app stores, sign-in providers and ad networks.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or for anything else that cannot be excluded or limited by law.

If you got the App from the App Store

If you downloaded Are You Fluent? from Apple's App Store, these extra terms apply:

These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the App and its content.
Your use of the App is also governed by Apple's Licensed Application End User License Agreement (the standard EULA), which applies alongside these Terms, and by the usage rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide any maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
You confirm that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
You must comply with any third-party terms that apply when you use the App, such as your mobile data agreement.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple will have the right to enforce them against you as a third-party beneficiary.

If you got the App from Google Play

If you downloaded Are You Fluent? from Google Play, the Google Play Terms of Service also apply to your use of Google Play. These Terms are between you and us, not Google, and Google is not responsible for the App.

Modifications to terms

We may update these Terms when the App or the law changes. The “Last updated” date at the top always shows the current version. If a change is important, we will tell you in the App or on this website before it applies. If you keep using the App after that, the new Terms apply; if you don't agree, you can stop using the App and delete your account.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute that is not resolved with us first will be decided by the state or federal courts located in Delaware, except where the mandatory rules described below give you the right to go to the courts where you live.

If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim in the courts there. If you have a problem with the App, please contact us first; most issues can be solved quickly by email.

Severability

If any part of these Terms turns out to be invalid or unenforceable, the rest still applies.
